Privacy Policy
NSY REAL ESTATE, LLC ("NSY," "the Brokerage," "we," "us," or "our"), a Utah limited liability company located at 949 N 900 W, Tremonton, UT 84337, United States, publishes this Privacy Policy to describe how information is collected, used, shared and protected in connection with this website and the Brokerage's ordinary real-estate business. This website was developed and is maintained by NSY REAL on behalf of the Brokerage. By using this website or contacting the broker's desk, you acknowledge the practices described below.
1. Information We Collect
1.1 Information you give us
When you send a listing inquiry slip, write to us or call the desk line, we collect what you send: your name, entity, email address, phone number, the rail you ask about, your side of the transaction, property and timeline details, and anything else you include. Until a representation agreement is signed, please do not send financial statements, loan documents or identity documents — the intake form is for first conversations.
1.2 Information collected automatically
Like most hosted websites, our hosting provider records standard technical data when pages load: IP address, browser and device type, referring page, pages viewed and timestamps. This data keeps the site available and secure; it is not used to build advertising profiles.
1.3 Transaction records
In the ordinary course of brokerage we keep records that may include personal and business information: representation agreements, agency disclosures, offers and counteroffers, earnest-money records, settlement statements, vendor and counterparty contacts, and correspondence. These are business and license-required records, handled under the duties owed to the client we represent.
2. How We Use Information
- To answer inquiries and place requests on the right rail — buy-side, sell-side or agency floor.
- To negotiate, document and perform representation: agreements, showings, offers, escrow coordination and closings.
- To satisfy license-law obligations: agency disclosure, record-keeping, trust-account documentation and fair-housing compliance.
- To maintain and secure the website, diagnose errors and guard against abuse.
- To meet legal, tax and accounting duties that apply to a Utah limited liability company.
We do not sell personal information, and we do not use your data for targeted advertising.
3. Cookies & Analytics
This website is a static site. We do not deploy advertising cookies, cross-site trackers or behavioral analytics of our own. Our hosting provider (Firebase Hosting, operated by Google) processes server logs under its own infrastructure policies. Loading fonts from Google Fonts exposes standard request data (such as your IP address) to Google; see Google's privacy documentation for details. If we ever introduce analytics or cookies of our own, this policy will be updated before they go live.
4. Sharing & Disclosure
We share information only where a transaction or the law requires it:
- Transaction parties — counterparties, title and escrow companies, lenders, inspectors, appraisers and other licensees where a deal requires it.
- Service providers — hosting, email delivery, transaction-management and accounting tools that process data on our behalf.
- Legal process — courts, the Utah Division of Real Estate, regulators or law enforcement where disclosure is legally compelled, or to protect the Brokerage's rights and safety.
- Business transfer — if the Brokerage's assets or membership interests are ever sold or reorganized, business records may transfer as part of that transaction.
5. Transaction & Client Files
Representation work generates confidential client files — agreements, disclosures, offer terms, financial instructions and closing documents. We treat them as confidential business records owed the duties of the agency relationship, restrict access to personnel working the transaction, and disclose them only to parties and authorities entitled to them. Client financial or identity documents are collected through transaction channels agreed with the client, never through the general inquiry form.
6. Data Retention
Website and server logs are retained per our hosting provider's standard schedule. Inquiry correspondence that does not become business is generally retained for up to 24 months. Transaction files — agreements, disclosures, trust records and closing documents — are kept for the period Utah license law and the transaction documents require, which can be several years. When records outlive their purpose and their legal clock, they are deleted or destroyed.
7. Security
We protect information with measures appropriate to a small brokerage: restricted access to email and transaction files, reputable hosted infrastructure, and HTTPS delivery of this website. No method of transmission or storage is perfectly secure; if we ever become aware of a breach affecting your information, we will respond as applicable law requires. Wire-fraud warning for every client: we will never email you changed wiring instructions. Verify all instructions by phone at a number you already trust before sending funds.
8. Your Choices & Rights
Depending on where you live, you may have rights to access, correct, delete or restrict use of your personal information, and to receive a copy of it. To exercise any right, email hello.nate.hughes@jerdurf.shop with enough detail to find your records. We will respond within the time the applicable law allows. Records we are required to keep — transaction files, trust records, tax documents — cannot be deleted before their retention period ends. If you believe your concern is unresolved, you may also have the right to raise it with your state or local data-protection authority.
9. Children's Privacy
This website and the Brokerage's services are directed at adult clients and transaction parties. We do not knowingly collect personal information from children under 16. If you believe a child has sent us personal information, contact the desk and we will delete it.
10. Changes to This Policy
We may update this policy as the website or our practices change. The current version is always posted here; material changes take effect when posted unless a later date is stated. Continuing to use the site after a change means you accept the updated policy.
